South Korean Journalists Acquitted on Charges of Defaming President’s Brother
대통령 동생 명예훼손 혐의 무죄 판결 받은 한국 언론인들

SEOUL, South Korea — Two journalists who have been vocal critics of South Korea’s president were acquitted Friday on charges of defaming her brother, in a case that rights groups saw as a test of freedom of speech here.
한국, 서울 – 금요일 한국 대통령에 대한 신랄한 비판을 해온 두 언론인이, 인권단체들이 한국의 언론의 자유에 대한 시험으로 간주했던 사건에서 대통령의 동생에 대한 명예훼손 혐의에 대해 무죄판결을 받았다.

Weeks before President Park Geun-hye’s election in December 2012, Choo Chin-woo, a reporter with the leading newsweekly SisaIN, and Kim Ou-joon, host of a popular politically oriented podcast, speculated that Ms. Park’s brother, Park Ji-man, might have been involved in the murder of a relative.
2012년 12월 박 대통령 당선 몇 주 전, 유력한 시사주간지 시사인의 주진우 기자와 인기있는 정치 팟캐스트 진행자인 김어준씨는 박 대통령의 동생 박지만씨가 친척의 살인 사건에 연루되었을지도 모른다는 의혹을 보도했다.

The two reported what they characterized as loopholes and contradictions in the police’s conclusion that the relative had been murdered by someone else, and they raised suspicion that Mr. Park, a businessman, had been involved in the 2011 killing. Mr. Park vehemently denied involvement and sued Mr. Choo and Mr. Kim. In 2013, prosecutors indicted the two on charge of defaming and spreading false information about Mr. Park with the intent of preventing his sister’s election.
두 언론인은 그 친척이 다른 누군가에 의해 살해되었다는 경찰의 결론에 대해 자기들이 보기에 허점투성이와 모순점들이 있음을 보도했고 사업가인 박 씨가 2011년 살인에 연루되었다는 의혹을 제기했다. 박지만씨는 자신이 연루됨을 단호하게 부인하고 주진우 기자와 김어준씨를 고소했다. 2013년 검찰은 박 대통령의 당선을 방해하기 위한 의도로 박지만의 명예를 훼손하고 허위정보를 유포했다는 혐의로 두 사람을 기소했다.

A court acquitted Mr. Choo and Mr. Kim in October 2013, but the prosecutors appealed the verdict, seeking prison terms of several years. Reporters Without Borders and a local media workers’ labor union accused prosecutors of abusing South Korea’s defamation laws to pressure reporters into censoring themselves and to undermine freedom of information.
재판부는 2013년 10월에 주진우 가자와 김어준씨에게 무죄를 선고했지만 검찰은 항소했고 수년 간의 징역형을 구형했다. 국경없는 기자회와 국내 언론노조는 검찰이 기자들이 자기검열를 하도록 압력을 가하고 정보의 자유를 훼손하기 위해 한국의 명예훼손법을 남용하고 있다고 비난했다.

On Friday, the appeals court in Seoul acquitted Mr. Choo and Mr. Kim again.
금요일 서울의 고등법원은 주진우 기자와 김어준씨에게 다시 무죄를 선고했다.

“There were enough grounds for the accused to raise the suspicion regardless of whether it was truthful or not,” the court said in its verdict. “Journalists’ activities should be fully guaranteed in an election year to help the people decide, and how to judge their reports should be left to readers and viewers.”
“그것이 사실이든 아니든 관계 없이 피고인들에게 의혹을 제기할만한 충분한 근거가 있었다”고 재판부는 판결문에서 말했다. “선거가 있는 해에는 대중들의 선택을 돕도록 언론인들의 활동은 전적으로 보장되어야하며, 기자들의 보도들을 어떻게 판단하느냐는 독자들과 시청자들에게 맡겨져야한다.”

International free speech advocates, including the United Nations special rapporteur on freedom of opinion and expression, have voiced concern about what they call a lack of tolerance for dissent in South Korea. Critics have said that the country’s justice system hampers the press by placing the burden of proof in defamation cases not on prosecutors, or on those who say they were defamed, but on defendants, even when the alleged victims are public figures.
의견과 표현의 자유 유엔 특별보고관을 포함한 국제 언론 자유 지지자들은 한국의 이른 바 ‘반대의견에 대한 무관용’에 대해서 우려를 표명했다. 비평가들은 한국의 사법체재가 명예훼손 사건에서 피해자들이 공인일 경우에도 사실을 입증할 책임을 검사나 명예훼손을 당했다고 주장하는 사람이 아니라 피고에게 부여함으로써 언론의 활동을 저해한다고 말해왔다.

Critics of Ms. Park have accused her government of abusing the law more generally to suppress freedom of speech. On Saturday, the government deported Shin Eun-mi, a Korean-American woman, who had been accused of breaking the country’s National Security Law by making positive comments about North Korea in lectures she gave last year. On Wednesday, a leftist political activist named Hwang Sun who co-hosted those lectures was arrested on charges of breaking the same law.
박 대통령에 대한 비평가들은 정부가 언론의 자유를 억압하기 위해 보다 일반적으로 법을 남용하고 있다며 박 정부를 비난했다. 지난 토요일 정부는 지난해 강연에서 북한에 대해 긍정적인 발언을 해서 국가보안법 위반 혐의를 받은 재미동포 신은미씨를 강제출국시켰다. 지난 수요일 강연을 함께 진행했던 좌익 정치 운동가 황선씨가 같은 국가보안법 위반 혐의로 구속됐다.
