PARK GEUN-HYE has had a tough ten days: 14 hours of interrogation by prosecutors, followed by another nine spent in a local court yesterday. The prosecutors had been waiting for months to serve the former South Korean president with an arrest warrant; it took the judges an extraordinarily long day of deliberation to weigh the merits of their request. As the former South Korean president left her home in Seoul to attend the hearing, flag-waving supporters lined the streets; several lay down in the road in an attempt to block her path to court.

박근혜는 검찰 조사 14시간, 그리고 이어서 어제 서울중앙지법에서 9시간을 보내는 등 힘든 10일을 보냈다. 검찰은 박근혜 전 대통령에게 구속영장을 제시하기 위해 몇 달을 기다려 왔으며, 검찰 요청의 정당성을 검토하면서 재판관들은 특별히 긴 숙고의 날을 보냈다. 박근혜 전 대통령이 영장실질심사를 받기 위해 서울의 자택을 떠날 때, 태극기를 흔드는 지지자들이 거리에 줄을 지었고 일부는 법원으로 가는 길을 막기 위해 도로에 드러눕기도 했다.

It was to no effect: shortly before dawn on March 31st, Ms Park was arrested at the prosecutors’ office. The justice who approved her pre-trial detention said that the main charges against her were “demonstrable” and that, were she allowed to leave, she might destroy evidence. Prosecutors had submitted 120,000 pages of documents to the court earlier this week concerning the 13 charges against Ms Park. In their warrant they noted that Ms Park had “let down the trust of the people”, was “consistently denying objective facts”, and “showing no signs of remorse”.

Yet her early imprisonment does not rule out a fierce battle in court: far more evidence would be required to prove criminal guilt than to justify a pre-trial arrest. When the constitutional court upheld a parliamentary motion to impeach Ms Park on March 10th, stripping her of state powers, she was deprived too of her immunity from investigation—allowing prosecutors to pounce. She was forced to leave the Blue House, the presidential mansion, while they burrowed into their probe. Now they may detain Ms Park for up to 20 days; if she is to stay behind bars, they must issue a formal indictment against her within that period. A snap presidential election has been set for May 9th. The prosecutors are expected to hurry along Ms Park’s case, and to press ahead with parallel investigations into other suspects in the scandal, while other politicians campaign for the presidency.

그러나 박근혜의 조기 구속수감이 법정에서의 치열한 공방전의 가능성을 없애는 것은 아니다. 범죄사실유죄를 입증하기 위해서는 사전구속을 정당화하는 데 필요한 것보다 더 많은 증거가 요구되기 때문이다. 헌법재판소가 3월 10일 국회의 탄핵소추안을 인용하여 박근혜를 파면시켰을 때 박근혜는 면책권 역시 박탈당했고, 따라서 검찰은 수사를 밀어붙일 수 있게 되었다. 검찰이 수사에 파고드는 동안 박근혜는 대통령 관저인 청와대에서 강제 퇴거 당했다. 이제 검찰은 박근혜를 최대 20일까지 구금할 수 있으며 만일 박근혜가 계속 구치소에 머물도록 하려면 검찰은 그 기간 내에 공식적으로 기소해야 한다. 대통령 보궐 선거가 5월 9일로 잡혀 있다. 검찰이 박근혜 사안을 서둘러 진행하고 스캔들에 연루된 다른 피의자들에 대한 수사도 동시에 추진하리라 기대되는 한편 정치인들은 대통령 선거 캠페인을 벌이고 있다.

Ms Park’s alleged crimes include bribery, coercion, the abuse of power and the sharing of state secrets with a long-time confidante, Choi Soon-sil. If Ms Park is convicted of all 13 of her charges, she could face up to 45 years in prison. Ms Choi has already been charged with bribery and influence-peddling, and has been held at the Seoul Detention Centre for four weeks. Lee Jae-yong, vice-chairman of Samsung, sits in another cell, accused of offering a bribe of 43bn won ($38m) to Ms Park and Ms Choi in exchange for state favours (Samsung denies there was any quid pro quo).

박근혜의 범죄 혐의들은 뇌물죄, 강요죄, 권한 남용 및 오랜 친구인 최순실과 국가기밀을 공유한 죄 등을 포함한다. 13개 혐의 모두에 대해 유죄로 선고된다면 박근혜는 최대 45년의 징역형에 처해질 수 있다. 최씨는 이미 뇌물죄와 국정개입으로 기소되었고 4주(역주: 4달의 잘못된 표기인 듯함, 실제로는 5달에 가까움) 동안 서울구치소에 수감되어 있는 상태다. 삼성 부회장 이재용은 청탁을 대가로 박근혜와 최씨에게 430억 원(3천8백만 달러) 뇌물을 제공한 혐의로 또 다른 감방에 수감되어 있다(삼성은 대가성은 아니었다고 부인하고 있다).

Ms Park now joins them with her own cell at the centre. She has repeatedly apologised for disappointing the nation, but has also consistently denied any wrongdoing. Even as she maintains that she never sought personal advantage for herself, she could still be charged as a “joint principal offender”, legal experts say—if prosecutors can prove that she was involved in planning to commit extortion with Ms Choi. They already accused her of being a “co-conspirator” in November, prior to her impeachment.

박근혜는 지금 이들과 같은 구치소의 독방으로 가게 된다. 박근혜는 국민을 실망시킨 점에 대해서는 수 차례 사과했지만 어떤 불법 행위도 하지 않았다고 계속 주장해왔다. 자신을 위한 개인적 이익을 결코 추구하지 않았다고 주장한다해도 박근혜가 최씨와 함께 돈을 빼앗을 것을 계획했다는 사실을 검찰이 증명할 수 있다면 박근혜는 “공동정범”으로 혐의를 받을 수 있다고 법률전문가들은 말한다. 검찰은 이미 박근혜 탄핵 이전인 11월 달에 박근혜를 “공모자”로 적시했다.

Outside the prosecutor’s office, a dozen of Ms Park’s die-hard supporters waved flags covered with messages that shrieked defiance: “When martial law comes you’ll all be dead!”, and “You should be struck down by lightning”. But elsewhere the mood was one of general approval; on social media many circulated jubilant messages. Over three-quarters of South Koreans support her impeachment; millions had demonstrated for it in the streets.

검찰청 밖에서는 십여 명의 박근혜 열혈 지지자들이 “계엄령으로 모두를 죽이자!”, “번개불에 태워 죽일 놈”과 같은 경악스러운 문구가 적힌 깃발을 흔들었다. 그러나 다른 모든 곳에서의 분위기는 전체적으로 이를 수용하는 것이었다. 소셜미디어에서는 많은 승리의 메시지가 돌았다. 한국인 4분의 3 이상이 박근혜 탄핵을 지지하고 있으며 수백만 명이 이를 위해 가두시위를 벌였다.

Candidates in the upcoming presidential election can be expected to join them in applauding Ms Park’s arrest. But her case is unlikely to sway the outcome of the election, which looks set to be a victory for the opposition Minjoo party, which is enjoying record-high approval ratings.

다가오는 대통령 선거의 후보자들도 박근혜의 구속을 국민과 함께 환영할 것으로 보인다. 그러나 박근혜 사안은 선거 결과에 어떤 영향도 미치지 못할 것으로 보이며, 현재 최고의 지지율을 누리는 야당 민주당의 승리가 이미 확정된 듯하다.

Ms Park becomes the country’s third former president to be arrested over criminal allegations. Chun Doo-hwan and Roh Tae-woo, two former military-era leaders, were convicted of treason, mutiny and corruption. Both were given special pardons in 1997 after serving only two years in jail, in an attempt to promote “national harmony” by the then-president, Kim Young-sam. Yet the 13 charges against Ms Park are the most ever issued to a former head of state, and the first since South Korea’s turbulent 1990s. If she is convicted, the mood is likely to be far less forgiving.

박근혜는 범죄 혐의로 구속된 세 번째 대통령이다. 전두환과 노태우 두 전직 군부시대 대통령은 반역, 반란 및 부패로 유죄선고를 받았다. 두 사람은 2년 복역 후 1997년 “국가화합”을 추진하고자 했던 당시 김영삼 대통령에 의해 특별 사면되었다. 그러나 박근혜에 대한 13가지 혐의는 전직 국가수장이 받은 가장 많은 것이며 1990년대 한국의 격동기 이후 처음이다. 박근혜가 유죄를 선고받게 되면 그 분위기는 용서와는 아주 거리가 멀 것이다.
